Please read these Terms of Service ("Terms," "Terms of Service") carefully before using the Ice Fisher Snowpark mobile application ("App") operated by Ice Fisher Snowpark developed by Paulo Filimone ("us," "we," or "our").
Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App.
By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the App.
1. Description of Service
Ice Fisher Snowpark is a mobile application designed to track skiing and snowboarding activities. The App allows users to:
- Record distance, vertical drop, speed, and duration of ski/snowboard runs
- Automatically detect runs and lifts
- View session history and statistics
- Log snow conditions and weather
- Access resort maps and terrain information
2. User Responsibilities
When using Ice Fisher Snowpark, you agree to:
- Use the App in compliance with all applicable laws and regulations
- Not use the App for any illegal or unauthorized purpose
- Not interfere with or disrupt the App or servers connected to the App
- Take full responsibility for your safety while skiing or snowboarding
- Not rely solely on the App for navigation or safety decisions
3. Safety Disclaimer
IMPORTANT: Ice Fisher Snowpark is designed as a tracking and logging tool only. The App is NOT a substitute for proper safety equipment, training, or judgment while skiing or snowboarding.
- Always follow resort rules and guidelines
- Ski or snowboard within your ability level
- Be aware of weather and snow conditions
- Do not use your phone while actively skiing or snowboarding
- The App should be used in "pocket mode" during active sessions
We are not responsible for any accidents, injuries, or damages that may occur while using the App or participating in skiing or snowboarding activities.
4. GPS and Location Data
The App uses GPS and location services to track your activities. You acknowledge that:
- GPS accuracy may vary based on device, conditions, and location
- Speed, distance, and elevation measurements are estimates and may not be precise
- The App may not function properly in areas with poor GPS signal
- Battery consumption may increase when using location services
5. Data Storage
All your tracking data is stored locally on your device. We do not store your GPS routes, session data, or personal records on our servers. You are responsible for backing up your data. If you uninstall the App or lose your device, your data may be permanently lost.
6. Intellectual Property
The App and its original content, features, and functionality are and will remain the exclusive property of Ice Fisher Snowpark developed by Paulo Filimone. The App is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without our prior written consent.
7. Third-Party Services
The App may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by or in connection with use of any such third-party content, goods, or services.
8. Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the App will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination.
9. Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, and hereby disclaim all warranties including, without limitation:
- Implied warranties of merchantability and fitness for a particular purpose
- That the App will be uninterrupted, error-free, or secure
- That the results from using the App will be accurate or reliable
- That any errors in the App will be corrected
10. Limitation of Liability
In no event shall Ice Fisher Snowpark developed by Paulo Filimone, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the App
- Any conduct or content of any third party on the App
- Any content obtained from the App
- Unauthorized access, use, or alteration of your transmissions or content
- Any physical injury or property damage resulting from skiing or snowboarding activities
11. Governing Law
These Terms shall be governed and construed in accordance with applicable laws, without regard to conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
